Terms of Service

These Terms of Service ("Terms") govern your use of the Skein mobile application ("the App") operated by CrushIT, Roman Nikitin, based in Spain ("we", "us", "our"). Skein was previously known as "Tarot Deck" during development.

By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. The App

Skein is an entertainment and personal reflection application. It provides a digital tarot deck, daily card practice, journaling, and astrology features for self-reflection and mindfulness.

Important: Card draws and interpretations provided by the App are for entertainment and self-reflection purposes only. They do not constitute professional advice of any kind (medical, financial, legal, psychological, or otherwise). You should not make important life decisions based solely on tarot card draws.

2. Accounts

You may use the App without creating an account. Core features work fully offline.
To sync data across devices and make purchases, you may sign in with Apple or Google.
You are responsible for maintaining the security of your account.
You must be at least 16 years old in the EU, or 13 years old elsewhere, to use the App.
We reserve the right to suspend accounts that violate these Terms.

3. In-App Purchases

The App offers optional cosmetic items (card decks, card backs, table styles, visual effects) for purchase.
All purchases are processed through Apple App Store or Google Play Store and are subject to their respective terms.
Cosmetic purchases are non-consumable — you buy them once and keep them permanently.
Purchased items are cosmetic only and do not affect app functionality or reading outcomes.
Refunds are handled by Apple or Google according to their refund policies.
Free and unlockable items may be earned through app usage (streaks, achievements, levels).
Prices may change at any time. Purchases made before a price change are not affected.

4. User Content

Journal entries and reflections you create are your content. You retain all rights to them.
We do not review, moderate, or use your journal content for any purpose other than storage and sync.
You may delete your content at any time through the App.
We are not responsible for the loss of locally stored content that was not synced to our servers.

5. Future Features

The App may introduce features including but not limited to:

AI-assisted readings: Interpretations generated by artificial intelligence. These are for entertainment only and do not represent human professional guidance.
Social features: Leagues, friend lists, and shared statistics. Any personal data shared through social features will be governed by our Privacy Policy.
Email communications: Optional weekly digests or updates, requiring separate opt-in consent.

We will update these Terms and our Privacy Policy before launching features that materially affect your data or rights.

6. Acceptable Use

You agree not to:

Reverse engineer, decompile, or attempt to extract the source code of the App.
Use the App for any unlawful purpose.
Attempt to gain unauthorized access to our servers or other users' data.
Redistribute, resell, or commercially exploit the App's content (card artwork, designs, sounds).
Use automated means (bots, scrapers) to access the App.
Harass, abuse, or harm other users through any future social features.

7. Intellectual Property

The App (Skein), including its name, design, artwork, card illustrations, animations, sounds, and code, is owned by CrushIT and protected by copyright and other intellectual property laws.
Card deck artwork is either original, AI-generated (owned by us), or licensed for commercial use.
Tarot card names and traditional symbolism are in the public domain.
You may not copy, reproduce, distribute, or create derivative works from the App's artwork or designs.

8. Disclaimer

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

The App will be uninterrupted, error-free, or secure.
Tarot readings will be accurate, meaningful, or applicable to your situation.
Data sync will work perfectly in all conditions.
AI-generated content (if available) will be accurate or appropriate.

9. Limitation of Liability

To the maximum extent permitted by applicable law, including Spanish and EU law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

Decisions made based on tarot readings or AI-generated interpretations.
Loss of data due to device failure or sync issues.
Service interruptions or unavailability.

Our total liability shall not exceed the amount you paid for in-app purchases in the 12 months preceding the claim.

10. Termination

You may stop using the App at any time by uninstalling it.
You may request account deletion by contacting us at r.nikitin.crushitapp@gmail.com.
We may suspend or terminate access to the App if you violate these Terms, with reasonable notice where possible.
Upon termination, your right to use the App ceases, but your locally stored data remains on your device.
Sections 7, 8, 9, and 11 survive termination.

11. Dispute Resolution

We encourage you to contact us first at r.nikitin.crushitapp@gmail.com to resolve any dispute informally.
If informal resolution fails, disputes shall be resolved in the courts of Spain.
For EU consumers: you may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

12. Changes to Terms

We may update these Terms from time to time. For material changes:

We will provide at least 14 days' notice through the App.
Continued use after the notice period constitutes acceptance.
If you do not agree with the changes, you may stop using the App and request account deletion.

13. Governing Law

These Terms are governed by the laws of Spain and applicable EU regulations, including GDPR and the EU Consumer Rights Directive. Nothing in these Terms affects your statutory rights as an EU consumer.
